ARTICLE 9. Competence of the authorized bodies
Authorized bodies in the implementation of administrative procedures:
- ensure a friendly, polite and attentive attitude of employees of the authorized body to interested parties;
- provide they take into account the timely and proper performance of the functions of temporarily absent employees of authorized bodies that are accepting interested persons by other employees of these bodies;
- explain to interested persons the obligation of authorized bodies to independently request documents and (or) information necessary for the implementation of administrative procedures, with the exception of those included in the lists of documents and (or) information submitted by interested parties, as well as the rights and obligations of those interested persons;
- free of charge provide interested persons with the forms (forms) of documents required by the legislation on administrative procedures for applying for administrative procedures and explain the procedure for filling out and submitting them;
- request from others government bodies, other organizations, documents and (or) information necessary for the implementation of administrative procedures;
- provide interested parties with the opportunity to familiarize themselves with materials related to the review of their statements, including with documents and (or) information received by these bodies from other state bodies, other organizations and necessary for the implementation of administrative procedures, to make extracts from them, unless otherwise provided by the law on state secrets, commercial or otherwise protected by law secrecy;
- notify interested parties of administrative decisions taken;
- explain to interested parties the procedure and deadlines for appealing administrative decisions;
- and other powers provided by this Law and other legislative acts on administrative procedures.
ARTICLE 10. Rights of interested persons
Interested parties have the right to:
- apply to the authorized bodies;
- receive free forms from the authorized bodies under the legislation on administrative procedures (forms ) documents necessary for applying for the implementation of administrative procedures;
- received from authorized bodies e of their rights and obligations;
- to take part in administrative procedures personally and (or) through their representatives, unless otherwise provided by legislative acts;
- to get acquainted with materials related to the consideration of their applications , make extracts from them, unless otherwise provided by law on state secrets, commercial or other secrets protected by law;
- receive administrative decisions or extracts from them;
- withdraw your application at any time until the completion of the administrative procedure;
- appeal against administrative decisions;
- exercise other rights provided for by this Law and other legislative acts on administrative procedures.
ARTICLE 11. Stakeholder Responsibilities
Interested parties must:
- be courteous to employees of authorized bodies and avoid obscene or abusive words or expressions in relation to such employees;
- submit to the authorized bodies the documents and (or) information included in the lists of documents and (or) information submitted by interested parties, as well as the documents specified in seventh of paragraph 2 of Article 15 of this Law, in case of demanding such documents;
- pay the fee charged during the implementation of administrative procedures;
- inform the authorized bodies in a timely manner of changes place of residence (place of stay), location during the period of the administrative procedure;
- to perform other duties stipulated by this Law and other legislative acts on administrative procedures.
ARTICLE 30. Procedure for appealing against administrative decisions
- An interested person has the right to appeal an administrative decision in an administrative (out-of-court) order.
- An administrative complaint is sent to a state body, another organization, superior to the authorized body, to the person who made the administrative decision, or to a state body or other organization, the competence of which in accordance with legislative acts includes the consideration of such complaints (hereinafter referred to as the body considering the complaint).
- Appeal of an administrative decision I am judicially executed after appealing against such a decision in an administrative (out-of-court) procedure, unless another procedure for appealing is provided for by legislative acts.
An appeal against an administrative decision in a judicial proceeding is carried out in accordance with the civil procedural or economic procedural legislation .
- Filing a complaint in an administrative (out-of-court) procedure does not deprive the person concerned of the right to file a complaint with the court.
